Fatality claims
In Alberta, eligible relatives of persons killed by
the negligence of another are entitled to specified compensation. A spouse is entitled to
$40,000. Eligible parents are entitled to $40,000.00. Eligible children are entitled to
$25,000.00 each.
In addition to this specified compensation, an
individual who has suffered financial loss as a result of the death of another is entitled
to claim compensation for the amount of his loss. Typically, the most significant loss is
the loss of the income which the deceased would likely have earned had he survived. There
may also be a claim for loss of parental care and guidance.
