Divorce Guide
A divorce is most commonly obtained on the grounds
that the couple has lived separate and apart for a period of at least one year. You can
also obtain a divorce in less than one year if you can prove that your spouse committed
adultery or was physically or emotionally abusive.
If the divorce is uncontested, it can be obtained by
submitting documents to the Court without the necessity of a court appearance.
If you are seriously considering divorce, you are
wise to seek legal advice. It is possible to obtain a do it yourself divorce in the
simplest of situations but you will likely find it a little trickier than you expected. If
the marriage has lasted more than a few years, if you have children, if you or your spouse
have accumulated property since the marriage or if one spouse is financially dependent on
the other, you will need legal assistance.
